Release Date: [2025] May [2] Welcome to Live Talk & Chat-Mental Health! Please read all the agreements carefully before using the products and services displayed on the Platform (hereinafter referred to as "Services"). If you do not agree to these terms, please do not use these services.
This Agreement applies to your use of Live Talk & Chat-Mental Health, including the features, applications, services, technologies and software provided by us, unless we explicitly state that a separate agreement applies. For the third party services attached in Live Talk & Chat-Mental Health, the goods or services involved in the third party sites accessed through advertisements or links, Live Talk & Chat-Mental Health has nothing to do with it and is not bound by this Agreement. Please pay attention to the service terms of the relevant third parties and comply with them. In addition to this Agreement, Live Talk & Chat-Mental Health will also formulate other types of agreement documents, user codes, and usage requirements according to the service conditions, and publicize them through the Platform. You should pay attention to and comply with them at any time. If you refuse to accept other agreement documents, user guidelines, administrative policies, and usage requirements, you may not be able to use part or all of Live Talk & Chat-Mental Health's services.
Please be sure to carefully read and fully understand the terms of this Agreement, especially the terms of exemption or limitation of liability, and the separate agreement for opening or using a service, and choose to accept or not accept. Limitations and disclaimers are provided in a reasonably highlighted font for your attention. Before you use Live Talk & Chat-Mental Health services, you must confirm that you have full civil capacity and can use our services independently (subject to the regulations of your country or region), and will not violate the restrictions or bans of laws and regulations, otherwise all legal liabilities caused by this shall be borne by you independently.
1-)You must comply with any agreement documents, user guidelines, management policies and usage requirements provided to you in the Service, including but not limited to this Agreement.
2-)You must not misuse our services. For example, you must not interfere with the normal provision of our services, and do not attempt to access Live Talk & Chat-Mental Health services using methods other than the interface and instructions provided by us; You shall abide by the principle of "fair use", that is, you shall not use Live Talk & Chat-Mental Health services by means of automation technology or other means beyond the normal frequency and quantity of use.
3-)You may use our Services only where permitted by law, including applicable export and re-export control laws and regulations. We may suspend or stop providing services to you if you do not comply with our agreements or policies, or if we are investigating suspected misconduct.
4-)The use of our Services does not grant you ownership of any intellectual property rights in our Services or the content you access, and you only provide you with a limited right to use the Services in accordance with relevant laws, regulations or agreements. This Agreement does not grant you the right to use any brand or logo used in our Services.
5-)When you use the Services, we may send you service announcements, administrative messages and other information. In the case of applicable laws and regulations, you may opt out of receiving some information.
6-)Most of our services can be used on mobile devices. You need to bear the equipment costs and network costs incurred when using the Service.
We use third-party Artificial Intelligence (AI) services to provide the chat and voice functionality in this app.
This app is an AI-powered companion for emotional support and entertainment purposes only. It does NOT provide medical diagnosis, treatment, or professional advice. Always consult a doctor for medical conditions.
Users are prohibited from generating illegal, abusive, or hateful content using the AI chat. We have a zero-tolerance policy. Any user found generating objectionable content will have their access terminated immediately.
Live Talk & Chat-Mental Health reserves the right at any time to modify the Application in a manner reasonable to the User
in order to further develop and improve its quality, or to cease offering the services provided with the Application.
If you elect to use Premium Subscription, you agree to the pricing and payment terms, as we may update them from time to time. Live Talk & Chat-Mental Health may add new services for additional fees and charges, or amend fees and charges for existing services, at any time in its sole discretion. Any change to our pricing or payment terms shall become effective in the billing cycle following notice of such change to you as provided in this Agreement.
Live Talk & Chat-Mental Health Subscription is payable in advance. All subscription and access charges for the Service are payable in advance. Live Talk & Chat-Mental Health reserves the right to offer free trial period, that will automatically renew to a paid subscription at the trial’s end. Live Talk & Chat-Mental Health is not responsible for any charges or expenses you incur resulting from charges billed by Live Talk & Chat-Mental Health in accordance with the Terms of Service (e.g. overdrawn accounts, exceeding credit card limit, etc.). By providing a credit card number or other payment method with advance authorization features (e.g. some PayPal accounts), you authorize Live Talk & Chat-Mental Health to continue charging the payment method for all charges due Live Talk & Chat-Mental Health until your Premium Subscription account is settled and is terminated by either you or Live Talk & Chat-Mental Health
- You purchased a Subscription or enabled a trial on Google Play: if you are eligible for a refund, you’ll have to
request it directly from Google. To request a refund, follow these instructions from the Google’s support page.
- However, there are a few exceptions that can lead to a positive response to a refund request.
As soon as your subscription period expires, we will not be able to refund you as the service will be considered consumed in full, unless otherwise provided by applicable law.
3.2
Please use the Application in a manner that does not interfere with, overburden, or damage the Application and does not jeopardize or circumvent the purpose of the Application. You may not circumvent or modify any security measures of the application yourself or through third parties.
3.3
You may use Live Talk & Chat-Mental Health for private and personal use only. Use of Live Talk & Chat-Mental Health for commercial purposes is not permitted.
3.4
All rights to the Software remain with Live Talk & Chat-Mental Health. You may not copy, modify, reverse engineer, decompile or distribute the Software provided to you.
3.5
If you are responsible for an infringement, you release Live Talk & Chat-Mental Health from liability towards third parties as well as the costs of reasonable legal defense. Furthermore, you are obliged to compensate Live Talk & Chat-Mental Health for the damage incurred in the event of a culpable violation
3.6
You are obliged, if third parties assert claims against Live Talk & Chat-Mental Health due to your infringement, to inform Live Talk & Chat-Mental Health comprehensively and immediately, asfar asthis is necessary for the examination and defense.
3.7
Personal data of other parties involved that is transmitted to you or becomes known to you may not be
processed by you and may not be transmitted to uninvolved third parties. This only applies if you have the consent of the other party.
4.1
Should any provision of these General Terms and Conditions of Business be invalid or unenforceable, or should they contain a loophole, this shall not affect the validity of the remaining provisions. In place of the ineffective provisions or to fill the gap, a provision shall apply that comes closest to the economic purpose of these terms and conditions.
4.2
We reserve the right to change these Terms from time to time to comply with legal requirements or to reflect changes in the functionality of Live Talk & Chat-Mental Health. If we change the TOS to your disadvantage, we will inform you by email. The current version of the TOS is available on the Live Talk & Chat-Mental Health website and in the smartphone app. The changes are considered accepted by you if you do not object to them within two weeks. We will point this out to you at the beginning of the period. We reserve the right to terminate this agreement in the event of an objection.
4.3
The place of fulfillment is Türkiye. Turkey law shall apply.
