The Phone Tracker - Find My Phone application (smartphone app) allows you to contact your family members quickly and easily
(or other small groups, hereinafter "family" or "family members") as well as share with each other current
locations. Before using Phone Tracker - Find My Phone, you should read these GTC carefully. You agree to these terms and
conditions when you start using Phone Tracker - Find My Phone.
1.2
The service content of the application does not include the use of the Internet required for this purpose. You must take care of the Internet access, the technical requirements and the configuration and performance of the end device for the use of the application and the up-to-datedness of the required software on your own responsibility and at your own expense.
1.3
The use of the application is free of charge for you in the basic version, with the exception of the costs for
the use of the mobile end device (e.g., connection costs). Individual additional functions in the app can be
purchased. The prior consent of the user is required for this. From a current use of the free offer of
Phone Tracker - Find My Phone, the user does not incur any future payment obligations

You acknowledge and agree that Phone Tracker - Find My Phone provides only an approximate location of the particular Family
Member, and a specific success is not guaranteed. The use of Phone Tracker - Find My Phone requires that the mobile device of
the family member is switched on and functional, has access to the Internet and that the location services
for Phone Tracker - Find My Phone are activated. The accuracy of the location depends on the performance of the device to be
located and the networks used, the availability of topographic data, and other factors likely to affect the
functionality and, in particular, the transmission of data via wireless networks and satellites, such as
weather conditions, landforms, buildings and other constructions, geographic and atmospheric conditions,
and others. Accordingly, by entering into this Agreement, you acknowledge that the results Phone Tracker - Find My Phone
provides may be inaccurate, delayed, or lost and therefore may not be reliable

We always strive to provide our service in the best possible quality. However, we are dependent on the
services of third parties and on infrastructure and equipment controlled or manufactured by third parties,
such as the Internet or mobile devices. To the extent that we cannot influence these third parties and the
quality of their products, as well as the availability of the infrastructure under your control, we cannot
ensure the uninterrupted availability of Phone Tracker - Find My Phone. In addition, we reserve the right to interrupt Phone Tracker - Find My Phone
from time to time to perform work necessary to maintain the Services
2.1
Phone Tracker - Find My Phone is not liable for the information transmitted (e.g., the location of a Family Member, an "alert"
from a Family Member, a short message from a Family Member) being accurate and complete and reaching
the User in a timely manner. We would like to inform you that Phone Tracker - Find My Phone is not suitable to prevent
emergencies. Phone Tracker - Find My Phone, in addition to traditional solutions such as telephone or SMS, serves only to
support internal family communication
2.2
For damages incurred by the user through the use of the application, Phone Tracker - Find My Phone is liable only for intent and
gross negligence on the part of Phone Tracker - Find My Phone. In particular, in cases where damage occurs due to incorrect,
incomplete, or delayed transmission of information or a lack of availability or disruption of the application,
Phone Tracker - Find My Phone is liable only to the extent that it was caused by intent or gross negligence. Otherwise,
Phone Tracker - Find My Phone is only liable for negligent breach of primary obligations. In this case, liability is limited to the
typically objectively foreseeable damage
2.3
Should the application or the transmission of data lead to impairments or damages of the hardware or
software of the user, Phone Tracker - Find My Phone is liable for these as far as they were caused by intent or gross negligence
on the part of Phone Tracker - Find My Phone. Phone Tracker - Find My Phone is not liable for a data loss of the user, because it is his responsibility to
take care of a data backup
2.4
If Phone Tracker - Find My Phone discontinues its service temporarily or permanently for good cause in whole or in part, this
circumstance does not justify any liability
Phone Tracker - Find My Phone reserves the right at any time to modify the Application in a manner reasonable to the User
in order to further develop and improve its quality, or to cease offering the services provided with the Application.
If you elect to use Premium Subscription, you agree to the pricing and payment terms, as we may update them from time to time. Phone Tracker - Find My Phone may add new services for additional fees and charges, or amend fees and charges for existing services, at any time in its sole discretion. Any change to our pricing or payment terms shall become effective in the billing cycle following notice of such change to you as provided in this Agreement.
Phone Tracker - Find My Phone Subscription is payable in advance. All subscription and access charges for the Service are payable in advance. Phone Tracker - Find My Phone reserves the right to offer free trial period, that will automatically renew to a paid subscription at the trial’s end. Phone Tracker - Find My Phone is not responsible for any charges or expenses you incur resulting from charges billed by Phone Tracker - Find My Phone in accordance with the Terms of Service (e.g. overdrawn accounts, exceeding credit card limit, etc.). By providing a credit card number or other payment method with advance authorization features (e.g. some PayPal accounts), you authorize Phone Tracker - Find My Phone to continue charging the payment method for all charges due Phone Tracker - Find My Phone until your Premium Subscription account is settled and is terminated by either you or Phone Tracker - Find My Phone
- You purchased a Subscription or enabled a trial on Google Play: if you are eligible for a refund, you’ll have to
request it directly from Google. To request a refund, follow these instructions from the Google’s support page.
- However, there are a few exceptions that can lead to a positive response to a refund request.
As soon as your subscription period expires, we will not be able to refund you as the service will be considered consumed in full, unless otherwise provided by applicable law.
3.1
Please do not use Phone Tracker - Find My Phone to defame, harass, "stalk" or threaten others, or to <br>
disseminate irrelevant, defamatory, obscene, salacious information.<br>
3.2
You are obliged to alwaysinform other people in your family before you let Phone Tracker - Find My Phone automatically inform
you about their current location (e.g., through the Places feature)
3.3
Please use the Application in a manner that does not interfere with, overburden, or damage the Application and does not jeopardize or circumvent the purpose of the Application. You may not circumvent or modify any security measures of the application yourself or through third parties.
3.4
You may use Phone Tracker - Find My Phone for private and personal use only. Use of Phone Tracker - Find My Phone for commercial purposes is not permitted.
3.5
All rights to the Software remain with Phone Tracker - Find My Phone. You may not copy, modify, reverse engineer, decompile or distribute the Software provided to you.
3.6
If you are responsible for an infringement, you release Phone Tracker - Find My Phone from liability towards third parties as well as the costs of reasonable legal defense. Furthermore, you are obliged to compensate Phone Tracker - Find My Phone for the damage incurred in the event of a culpable violation
3.7
You are obliged, if third parties assert claims against Phone Tracker - Find My Phone due to your infringement, to inform Phone Tracker - Find My Phone comprehensively and immediately, asfar asthis is necessary for the examination and defense.
3.8
Personal data of other parties involved that is transmitted to you or becomes known to you may not be
processed by you and may not be transmitted to uninvolved third parties. This only applies if you have the consent of the other party.
4.1
Should any provision of these General Terms and Conditions of Business be invalid or unenforceable, or should they contain a loophole, this shall not affect the validity of the remaining provisions. In place of the ineffective provisions or to fill the gap, a provision shall apply that comes closest to the economic purpose of these terms and conditions.
4.2
We reserve the right to change these Terms from time to time to comply with legal requirements or to reflect changes in the functionality of Phone Tracker - Find My Phone. If we change the TOS to your disadvantage, we will inform you by email. The current version of the TOS is available on the Phone Tracker - Find My Phone website and in the smartphone app. The changes are considered accepted by you if you do not object to them within two weeks. We will point this out to you at the beginning of the period. We reserve the right to terminate this agreement in the event of an objection.
4.3
The place of fulfillment is Türkiye. Turkey law shall apply.
